Welcome to TroveArt! These Terms and Conditions (“Terms”) govern your use of the website https://www.thewallarts.shop (the “Site”) and any purchases you make from our online store. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About TroveArt

TroveArt is an online retailer specialising in premium wall art, canvas prints, framed artwork, and home & office decoration products. We are based in Sri Lanka and ship our products domestically and internationally.

2. Eligibility

By using our Site and placing orders, you confirm that:

  • You are at least 18 years of age, or you have the consent of a parent or guardian.
  • The information you provide during registration and checkout is accurate and complete.
  • You have the legal authority to enter into a binding agreement.

3. Products & Descriptions

  • We make every effort to display our wall art products as accurately as possible, including colours, sizes, and materials. However, actual colours may vary slightly due to monitor settings and lighting conditions.
  • Product dimensions and specifications are listed on each product page. Please review them carefully before ordering.
  • We reserve the right to modify, discontinue, or limit the availability of any product at any time without prior notice.

4. Pricing & Currency

  • All prices on our Site are displayed in Sri Lankan Rupees (LKR) unless otherwise stated.
  • Prices include applicable taxes unless explicitly mentioned otherwise.
  • PayPal Payments: Since PayPal does not support LKR, your order total will be automatically converted from LKR to US Dollars (USD) at the prevailing exchange rate at the time of checkout. The converted USD amount will be displayed before you confirm payment.
  • We reserve the right to change prices at any time. Price changes do not affect orders already placed and confirmed.

5. Orders & Payment

  • Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order.
  • An order confirmation email does not guarantee acceptance. The order is confirmed only once payment is successfully processed and we send a shipping notification.
  • We accept payments via PayPal (USD conversion), bank transfer, and other payment methods as displayed at checkout.
  • All payments must be completed before orders are dispatched.

6. Shipping & Delivery

  • We aim to dispatch orders within 2–5 business days after payment confirmation.
  • Delivery times vary depending on your location and the shipping method selected.
  • Shipping costs are calculated at checkout based on your delivery address and the size/weight of the items.
  • TroveArt is not responsible for delays caused by courier services, customs procedures, or unforeseen circumstances.
  • Risk of loss passes to you upon delivery of the products to the carrier.

7. Returns, Exchanges & Refunds

8. Intellectual Property

  • All content on this Site — including but not limited to artwork images, product photographs, text, logos, graphics, website design, and software — is the property of TroveArt or our licensed artists and is protected by copyright and intellectual property laws.
  • You may not reproduce, distribute, modify, display, sell, or create derivative works from any content on this Site without our prior written consent.
  • The wall art you purchase is for personal use and decoration. Commercial reproduction of purchased artwork is strictly prohibited.

9. User Accounts

  • You may create an account to track orders, save your wishlist, and speed up checkout.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

10. User Reviews & Content

  • You may submit product reviews and ratings on our Site.
  • By submitting a review, you grant TroveArt a non-exclusive, royalty-free, perpetual licence to use, reproduce, and display your review on our Site and marketing materials.
  • Reviews must be honest, respectful, and based on genuine experience with our products.
  • We reserve the right to remove reviews that are abusive, misleading, contain spam, or violate any laws.

11. Limitation of Liability

  • TroveArt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products.
  • Our total liability for any claim related to a purchase shall not exceed the amount you paid for the specific product.
  • We are not liable for any colour variation between the product displayed on screen and the actual product received, as colours depend on your display settings.
  • We are not liable for damage to walls or surfaces resulting from the installation of our products.

12. Indemnification

You agree to indemnify and hold harmless TroveArt, its owners, employees, and partners from any claims, losses, or damages (including legal fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

13. Force Majeure

TroveArt shall not be held liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, government actions, supply chain disruptions, or internet outages.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
